If You Lose

If the Immigration Judge denies your asylum application, you can appeal to the Board of Immigration Appeals. You have 30 days to file the appeal (you also need a lawyer to help you with this).
The appeal should be mailed to the following address:

Appeals generally take a very long time, anywhere from 6 months to over a year. If you have a work authorization at the time you file your appeal, you are able to keep it.

Unfortunately the Board of Immigration Appeals (BIA) almost always agrees with the Immigration Judge. If the BIA affirms the denial, you can appeal to the Federal Court of Appeals in your district, which in New York is the Second Circuit Court of Appeals.
